Commercial License (Standard)
License Grant
- On purchase of an image with the “Commercial License (Standard)”, Kraskoff Photos grants you a non-exclusive, non-transferable, worldwide right to use the licensed image for commercial purposes as described below.
Permitted Uses
- Use in marketing materials, websites, social media ads, email campaigns, brochures, presentations, and promotional items.
- Use in digital or printed advertising for products or services, including product packaging and point-of-sale displays.
- Use in editorial content that promotes a commercial purpose (e.g., corporate blog posts).
Restrictions
- You may not resell, sublicense, distribute, or make the image available for download as a standalone file.
- You may not use the image in a trademark, service mark, or logo.
- You may not portray identifiable people in a defamatory, pornographic, or otherwise unlawful manner.
- If the image contains identifiable people or private property, additional model or property releases may be required for certain commercial uses; the purchaser is responsible for obtaining those releases if not provided.
Usage Limits and Attribution
- Unless an extended license is purchased, the image may be used for up to 500,000 impressions.
- Attribution is required. Credit must read: ‘Photo: Kraskoff Photos’ and be placed adjacent to the image where reasonably visible.
Derivative Works and Alterations
- You may crop, resize, color-correct, or otherwise modify the image for permitted uses.
- You may incorporate the image into derivative works provided the restrictions above are observed.
Transfer and Sub-licensing
- This license is non-transferable and does not permit sublicensing. Clients who wish to transfer rights should contact Kraskoff Photos for an extended or enterprise license.
Liability and Warranty
- Images are provided “as is.” Kraskoff Photos warrants it has the right to license the image but disclaims all other warranties. Kraskoff Photos’ maximum liability for any claim relating to the image will not exceed the purchase price paid for the image.
Editorial License (Editorial Use Only)
License Grant
- On purchase of an image with the “Editorial License,” Kraskoff Photos grants a non-exclusive, non-transferable, worldwide right to use the image for editorial, news, or informational purposes only.
Permitted Uses
- Use in newspapers, magazines, blogs, news websites, educational materials, books, documentaries, and similar non-commercial editorial contexts.
- Use to illustrate events, stories, or news items where the image’s content is relevant.
Restrictions
- Editorial License does NOT permit commercial use, including advertising, promotional, merchandising, product packaging, or any use intended to promote a product, service, or brand.
- You may not use the image in a way that suggests endorsement of products, services, or political positions by any identifiable person or brand depicted.
- No resale, sublicensing, or making the image available for download as a standalone file.
Model/Property Releases
- Images sold under an Editorial License do not include model or property releases and therefore are not suitable for commercial usage.
Attribution
- Attribution is required . “Photo: Kraskoff Photos” should appear near the image where reasonably visible.
Liability and Warranty
- Images are provided “as is.” Kraskoff Photos warrants it has the right to license the image for editorial use but disclaims other warranties. Kraskoff Photos’ maximum liability will not exceed the purchase price paid for the image.
